These Terms and Conditions govern the use of the Nolximo platform (nolximo.com), operated by Nolximo SpA, Tax ID 77.345.612-K, with registered address at Av. Apoquindo 4700, Office 1203, Las Condes, Santiago, Chile. By accessing and using this platform, you fully accept these terms.
1. Description of the service
Nolximo is a real estate crowdlending platform that allows individuals and legal entities to collectively invest in construction and urban development projects in Chile. The platform acts as an intermediary between investors and real estate project developers, facilitating fundraising, investment management, and return distribution.
2. Requirements for using the platform
To register and operate on Nolximo, the user must: (a) be at least 18 years old; (b) reside in Chile or in a country where legislation permits this type of investment; (c) provide truthful and complete information during the registration process; (d) comply with identity verification procedures required by current anti-money laundering and counter-terrorism financing regulations.
3. Nature of investment
Investments made through Nolximo are subject to risks inherent to the real estate market. Nolximo does not guarantee any profitability or the recovery of invested capital. Each project presents its own risks, which are detailed in its informational sheet. The user acknowledges having read and understood the associated risks before making any investment.
4. User obligations
The user agrees to: (a) use the platform lawfully and in accordance with these Terms; (b) not engage in activities that may damage, disable, or impair the platform's operation; (c) maintain the confidentiality of their access credentials; (d) immediately notify Nolximo of any unauthorized use of their account; (e) provide updated and truthful information at all times.
5. Intellectual property
All content on the Nolximo platform, including text, graphics, logos, images, software, and source code, is the property of Nolximo SpA or its licensors and is protected by Chilean and international intellectual property laws. Reproduction, distribution, modification, or commercial use of content without prior written authorization from Nolximo is prohibited.
6. Limitation of liability
Nolximo shall not be liable for: (a) losses arising from investments made by the user, including capital losses; (b) service interruptions due to force majeure, scheduled maintenance, or technical failures beyond our control; (c) damages caused by the user's non-compliance with these Terms; (d) the accuracy of information provided by project developers, although Nolximo performs reasonable verifications.
7. Fees and costs
Applicable fees for each investment will be clearly and transparently disclosed before the user confirms participation in a project. Nolximo reserves the right to modify fees, with prior notice to users as provided in these Terms.
8. Dispute resolution
Any dispute arising from the interpretation or application of these Terms shall be resolved first through direct negotiation between the parties. If no agreement is reached, the parties shall submit to mediation and, if necessary, to arbitration in accordance with the rules of the Santiago Arbitration and Mediation Center (CAM Santiago). The applicable law shall be Chilean legislation.
9. Amendments
Nolximo reserves the right to amend these Terms and Conditions at any time. Amendments shall take effect from their publication on the platform. Continued use of the service after publication of amendments implies acceptance thereof.
10. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Chile. For any judicial purpose, the parties submit to the jurisdiction of the ordinary courts of the city of Santiago, Chile, expressly waiving any other jurisdiction that may correspond.
